Dis-Chem Pharmacies has an opportunity available for an HR Litigation Manager at our Head Office in Midrand to join the team. You will be required to manage and oversee Employee Relations and Litigation matters. Serve as the primary contact for all HR litigation related matters and provides expert Labour Law support to management. Represents the company in employment of litigation matters on various levels and in various courts and CCMA.
Minimum Requirements:
Essential:
- Grade 12 / Matric
- Bachelor Degree in law
- Minimum of 4 to 6 years’ experience as a Litigation Specialist
Advantage:
- Post Graduate Qualification in Law and/or Labour Relations
- Litigation management experience in Retail or FMCG Industry
Job Specification:
- Oversee all aspects of the company’s litigation and dispute resolution processes.
- Manage all stages of employment-related litigation, including pre-litigation disputes, administrative proceedings, and court cases.
- Develop and implement litigation strategies to achieve favourable outcomes and minimize legal exposure.
- Coordinate with internal stakeholders to ensure timely and effective resolution of labour cases.
- Monitor legal developments and trends related to employment law to inform stakeholders and ensure constant compliance.
- Collaborate with HR teams to implement policies, procedures, and training programs aimed at mitigating legal risks and promoting compliance with applicable employment laws and regulations.
- Provide guidance and support management on measures to prevent labour disputes by ensuring proper documentation, disciplinary actions, and employee relations practices.
- Provide training and guidance to HR and management teams on legal compliance matters, including anti-discrimination laws, wage and hour regulations, and employee rights.
- Conduct thorough legal research to support litigation strategies and case preparations.
- Ensure that all litigation activities comply with relevant laws, regulations, and company policies.
- Conduct thorough and impartial investigations into employee complaints, grievances, and allegations of misconduct.
- Recommend appropriate courses of action based on investigation findings, including disciplinary actions, mediation, or legal proceedings.
- Facilitate dispute resolution processes, including mediation and settlement negotiations, to resolve conflicts in a timely and cost-effective manner.
- Chair Disciplinary hearings.
- Represent the company in CCMA for, inter alia: Con/Arb processes, Conciliations, Arbitrations and any other matters as they arise.
- Represent the company at various courts as and when required.
- Perform incapacity investigation and processing. (Poor work performance and Ill Health)
- Draft / or perusing of Recognitions agreements/ wage and or any other agreements pertaining to Employee/ Union related matters.
- Maintain accurate and comprehensive records related to litigation matters, investigations, and legal correspondence.
- Ensure compliance with document retention policies and procedures, including preservation of evidence and confidential information.
- Prepare reports and presentations for senior management and legal counsel regarding litigation status
- Review and/ or any other relevant litigation work to the Labour Court.
- Draft of written correspondence to the Department of Labour.
- Draft of employment Contracts and other Contracts/agreements.
- Prepare reports and presentations on litigation outcomes, trends, and propose recommendations.
